Please be aware that, although you are shopping on the myfood.mt website, we use the service of maltasupermarket to fulfill your order. Therefore, it is very likely that your bank will display your shopping as billed by maltasupermarket.
By using myfood.mt you agree to be bound by these Terms and Conditions. We have set out the guidelines below to let you know what you can expect from us and see the terms on which you place your order. If you do not agree to these terms and conditions please do not use this website.
Myfood.mt (hereinafter referred to as the ‘website’) in partnership with maltasupermarket, offers online shopping service to addresses in Malta only (Gozo & Comino not included) including homes, offices and yacht marinas. By using or submitting an order (and any subsequent orders) on this website you are agreeing to the terms that appear below.
Use of the website
1.1 To place an order on www.myfood.mt you should be over 18 years of age, have a credit/debit card accepted by us in your name and you must ensure that the details provided by you on registration or at any time are correct and complete.
1.2 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
1.3 Do not share your website password created upon registering on www.myfood.mt with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting our Customer Care Department (Email: email@example.com) immediately.
Pricing & Delivery
2.1 The prices and offers on the website do not necessarily reflect the prices in our supermarkets. The operations of the website are independent of our partner supermarkets and we may decide to make any extra special offers on the website and not in the supermarkets and vice versa.
2.2 In addition to the price there is a delivery charge of Five Euros (€5) to any of the zones we deliver, unless you spent Seventy-Five Euros (€75) or more, in which case delivery is free. No deliveries are made on Sundays, public and national holidays, and during any stock taking exercise undertaken by the online supermarket.
2.3 Whilst every care is taken to ensure correct pricing online, including but not limited to updating pricing on a daily basis, the actual amount charged upon delivery might be different from the one shown online especially due to stock price fluctuations upon which we have no control. We only charge for products delivered.
2.4 As it is difficult to select loose items such as fruit, vegetables, meat and poultry, etc. to an exact weight, we will charge you for the actual weight picked - and we always try to deliver as closes as possible to the weight you ordered/requested online.
2.5 Pre-Authorisation Procedure: For Your protection and security, and in order to verify the debit or credit card details provided, we will contact your card issuer on the day you checkout your order to request a pre-authorisation of One Euro (€1.00). We will verify your card for One Euro (€1.00) each time you amend your order. It is important to point out that this pre-authorisation is NOT a charge to your card and will not be billed to you. Your card issuer may hold this amount for a short period, but this will never be withdrawn from your account. On the evening before delivery we will request another pre-authorisation for the full order amount in addition to the One Euro (€1.00) pre-authorisation amount. We do this to ensure that your card details are still valid and that you have sufficient funds to complete the transaction. We take NO payments from your account before your order is delivered, so you will only be charged for items once they are delivered. In the unlikely event that the One Euro (€1.00) pre-authorisation is initially unsuccessful (and subsequently approved), and you amend your order following the full value pre-authorisation, you may be pre-authorised twice. However, only one payment will be withdrawn from your card. In a small number of cases, some card issuers may hold the full pre-authorisation amount for a limited time (usually 3-10 days). These funds will NOT be taken from your account and are not held by myfood.mt or by maltasupermarket.com.
2.6 All prices quoted are inclusive of any Value Added Tax at the rate of 18% or other sales taxes applicable in Malta.
2.7 There is a charge of Five Euros (€ 5) on all deliveries not to ground floor level with no lift.
3.1 Payment is to be effected via credit/debit cards.
3.2 Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for products and in the event that the payment card has expired we will be unable to take payment and/or fulfill your order.
4.1 From time to time certain parts of, or the whole website may not be available due to maintenance work. We shall give as much notice as in the circumstances is reasonable and shall endeavour to carry out such works during the scheduled maintenance periods. Furthermore, the site or parts of it may not be available to circumstances beyond our control. We apologies for such inconveniences in advance.
5.1 Many Internet users are especially worried on the issue of security. We would like to set your minds at rest with the knowledge that our site is built with all the necessary security precautions.
5.2. The user is responsible for any telephone, ADSL, cable or other connection and Internet charges incurred while connecting to or using our website.
5.3 The user is responsible for all of the user's account and confidentiality of his/her passwords. We will suspend access or change access to user's account immediately upon notification by the user that the password has been lost, stolen, or otherwise compromised.
6.1 All designs, text, graphics, instructions, reviews, including the selection and arrangement thereof, and all software is the property of the company and/or its Internet suppliers and is covered by international copyright laws. Permission is granted to view, electronically copy and to print in hard copy portions of this website for the sole purpose of using this website as a shopping channel or an alternative Internet resource. Any other use of materials on this website, including reproduction for purposes other than those noted above, modification, distribution, or republication, without the prior written permission of the company and/or its Internet suppliers is strictly prohibited.
7.1 This site and its contents are provided on an as is basis without representations or warranties of any kind with respect to this website and/or its contents. We disclaim all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that the information accessible via this website is accurate, complete or current, although we take all necessary precautions so that it is such. Price and availability information is subject to change without prior notice. Neither the company nor any of its directors and/or employees and/or representatives will be liable for damage of any kind arising out of the use of this website, and/or the merchandise purchased including but not limited to direct, indirect, incidental, punitive and compensatory damages. Furthermore, neither the company's suppliers nor any of its directors and/or employees and/or representatives will be liable for damage of any kind arising out of the use of this website, and/or the merchandise purchased including but not limited to direct, indirect, incidental, punitive and compensatory damages.
7.2 Except as specifically stated on this website, neither the company and/or any of its directors and/or any of its employees and/or any of its representatives and/or its suppliers and/or any of their directors and/or any of their employees and/or any of their representatives will be liable for damages arising out of or in connection with the use of this website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
7.4 Country of Origin: We take great care to source our fresh produce from sustainable and ethical sources, supporting growers when seasonality and availability permit. This involves produce being sourced when it is in season from various countries around the world. Consequently you may receive the same product from a number of different countries throughout the year. You will be able to see the Country of Origin on the pack at the point of delivery or alternatively you can ring our Customer Care Department store and ask for the country of origin of any item of produce. If the country of origin of our produce does not meet your expectations we will happily refund the money. Please let us know as soon as possible after you receive your order. But remember, we need to receive this within seven (7) days after you received your order. You must store the goods in the manner appropriate to the type of goods (e.g. keep chilled items chilled) as we may require them to be returned and they must be returned to us in the same condition they were delivered to you.
Stock Shortages on Popular Products
8.1 We do our best to ensure that we have consistent availability but we do occasionally run out of some products. When you place your order we will ask if you would like us to substitute an alternative similar product if your chosen products are not in stock at the time we dispatch your order. If you do and when you receive your order, you are still not happy with the substitution, please let us know as soon as you can so that we may handle this in accordance with these terms and conditions. Our drivers are trained to take you through the substitutions on the doorstep so if you let our driver know s/he will take the products away at that time.
9.1 Your right to return an item does not apply to certain products unless these goods are faulty on delivery or mis-described. Such items include:
- Newspapers and magazines;
- CDs, DVDs, videos and computer software, which may be restricted to an exchange for the same title to reduce the risk of unlicensed copying;
- perishable items;
- items which cannot be resold for health and hygiene reasons once unwrapped (for example body jewellery, mattresses, bedding, certain items of clothing, personal grooming products, medicines and certain baby products etc.); and/or
- flat packed furniture that has been partially or fully assembled; and items which have been installed using our installation service.
You are required to take reasonable care of items. Please return an item in its original and undamaged packaging with all of its components. If an item is returned undamaged in its original and undamaged packaging, we will offer you a refund in accordance with our returns policy. Your rights under consumer legislation for these goods are not affected.
9.2 If you return goods or cancel your order under this clause 9 and we have already debited your card, we will reimburse any sum received from you in respect of such goods by crediting the card you paid with.
9.3 Customers can return food items within twenty-four (24) hours, not including Sundays and/or Public and/or National Holidays. Non-food items can be returned within fifteen (15) days not including Sundays and/or Public and/or National Holidays. Delivery cost is spread over all the shopping not just one item so such cost will not be considered / refunded. If you buy only one item and you incurred a delivery charge in respect of such one item, and such item is returned back to us, we will refund the cost of delivery as well.
9.4 We will replace the damaged items by identical items in good condition or will otherwise grant a refund depending on the customer’s preference.
9.5 If the client wishes to return any item purchased for whatever reason, he/she may do so by returning the goods at our stored namely, Welbee's Supermarkets with the respective receipt. From there onwards the shop return policy will come into effect, that is either by exchanging items, offset from the bill or else the customer is granted a credit note.
10.1 Images used on the site are for illustration purposes only. Most images fit the product description exactly, in some rare cases product images may vary from the actual delivered product.
